MMK attorneys Jennifer Simmons, Jeffery Struckhoff and Dominic Ciaccio successfully prevailed on a Motion for Summary Judgment on behalf of their client, an apartment complex, regarding a slip and fall accident. In dismissing Plaintiff’s case, the Court ruled the conditions complained of were open and obvious and not unreasonably dangerous. The Court further ruled that a pedestrian has a duty to see that which should be seen and is bound to observe her course to see if it is clear.
