Renee Melchiode and Rich King successfully won a Motion for Summary Judgement before the Honorable Rachel Johnson in Civil District Court which was affirmed by the Louisiana Fourth Circuit Court of Appeal. Plaintiff fell while delivering her husband’s lunch at his worksite. Plaintiff allegedly fell into a hole at the container dock measuring 18×38 inches by 3 inches deep, injuring her knee, shoulder and back. Plaintiff admitted she did not see the hole because “I never looked down.” Then she reiterated, “walking towards him, never looked at the ground, going or coming. I never looked at the ground.” The hole was determined to be open and obvious and thus, no duty was owed to Plaintiff. Robertson v. The Kearney Companies, Inc., 2020-CA-0605 (La. App. 4Cir. 3/25/21).
