Jerry Melchiode and Ben Pri-Tal prevail on summary judgment having all claims dismissed against their client’s surety in a construction dispute. The court found that as a conventional bond it was limited to its terms and no cause of action existed against the performance bond surety once the owner accepted the project. Further, per the language of the bond, any potential claim for delay damages was not recoverable.
