Jerry Melchiode, Ben Pri-Tal, and Taylor Somerville prevailed on a Motion for Summary Judgment on behalf of a roofing contractor in a personal injury claim. Plaintiff, a former student at a public school, sought over $1,000,000.00 for injuries sustained in a slip and fall accident which required multiple surgeries. The roofing contractor had recently made repairs to the roof prior to the incident. The Court granted Summary Judgment finding that the Plaintiff could not prove the source of the liquid that allegedly caused his fall. Nor could the plaintiff maintain his burden of proof that there was any defective workmanship by the roofing contractor in repairs performed before the accident, even if the liquid was water from the roof.
