Jennifer Simmons and Ben Pri-Tal successfully defended an industrial services employer against allegations of sexual harassment, discrimination, hostile work environment, constructive discharge, and retaliation by a former employee against her then-supervisor.
In granting summary judgment in favor of the employer, the Court ruled that the plaintiff could not meet the requisite burden of proof to proceed to trial, finding that the plaintiff voluntarily resigned; did not inform or give notice to the employer of the accusations until after she voluntary resigned; the employer did not know nor could have known of the alleged harassment; the employer had a strict harassment policy in place; and once notice was given, the employer immediately began an exhaustive investigation and remedial measures.
