MMK attorneys Jennifer Simmons and Matthew Biggers obtained a summary judgment in favor of an apartment complex owner on a plaintiff’s claims of wrongful death and failure to provide proper safety. The claims arose from the shooting death of the plaintiff’s non-tenant family member during the commission of illegal activities by unknown third parties at the apartment complex. The 19th Judicial District Court for the Parish of Baton Rouge held that the apartment complex owner owed no duty to the decedent or the plaintiff to protect the decedent from the unforeseeable criminal activities of unknown third parties and dismissed the plaintiff’s claims with prejudice.
